Checklist for impact assessment of regulations on competition

The Public Policy Secretariat and The Commission for Protection of Competition have jointly developed a Checklist for impact assessment of regulations on competition (hereinafter: Checklist).

The checklist for impact assessment of regulations on competition is an auxiliary tool that facilitates the competent authorities, i.e. proposers of regulations, to properly assess the impact of regulations on competition, i.e. whether a particular proposal/draft regulation may lead to distortions of competition in the market. If the possibility of such an impact is determined on the basis of this list, the proposal/draft regulation should be submitted to the Commission for Protection of Competition for an opinion. In accordance with the Law on Protection of Competition, the Commission for Protection of Competition is the competent institution for providing opinions to competent authorities on draft regulations, as well as on valid regulations that have an impact on competition on the market.

Please note that other tools that are applied during the impact assessment of regulations are also available on the PPS website, and they include the Impact Assessment Test on micro, small and medium-sized economic entities (hereinafter: MSME test) and the Calculator for calculating the administrative cost using the standard cost method (hereinafter: Calculator).

The MSME test is a tool that is used during the planning, drafting and adoption of regulations within the framework of the ex-ante analysis of effects. Conducting the MSME test is a mandatory step in accordance with the Regulation on the Methodology of Public Policy Management, Policy and Regulatory Impact. Assessment, and Content of Individual Public Policy Documents and it is used to analyse proposed solutions in regulations that have an impact on micro, small and medium-sized economic entities, as well as alternative options that reduce the burden on these economic entities. In doing so, it is taken into account that the analysis and level of detail contained in the MSME test should be proportional to the importance of the regulation, i.e. the potential burden on micro, small and medium-sized economic entities that the regulation imposes on them. The calculator enables the calculation of administrative costs incurred during the implementation of administrative procedures and administrative requests, i.e. the costs of the activities that the subject of regulation (citizen and business or other subject) needs to carry out in order to exercise their rights and obligations through an administrative procedure or request. The standard cost model requires the breakdown of administrative procedures and requirements into administrative activities that entities undergoing regulation must implement in order to exercise their rights and obligations. Then, data on the time required for its implementation, the tariff (average earnings) as well as data on other costs required by the given activities are added to each activity. After calculating the costs for each administrative activity in this way, the Calculator calculates the entire administrative cost. The calculator is available at the following link
